Understanding Naturalization

Naturalization is the process by which a foreign citizen or national becomes a U.S. citizen. The requirements for naturalization vary depending on your individual circumstances, such as marriage to a U.S. citizen or military service. A naturalization attorney can help you determine your eligibility and guide you through the complex application process.

At PVB Law LLC, we're dedicated to making your journey to U.S. citizenship as smooth as possible. Understanding the eligibility requirements for naturalization is a crucial first step.

Here's a simplified list of the requirements:

  • You must be at least 18 years old when you file Form N-400, Application for Naturalization.

  • You should have been a permanent resident (green card holder) for at least 5 years, or 3 years if you're filing as a spouse of a U.S. citizen

  • You must have lived for at least 3 months in the state or USCIS district where you apply. As we're based in Augusta, Georgia, we're well-equipped to assist clients who reside in this region.

  • You need to demonstrate continuous residence in the U.S. for at least 5 years immediately preceding the date of filing Form N-400.

  • You should be able to read, write, and speak basic English and have a basic understanding of U.S. history and government (civics)

  • You must be a person of good moral character, attached to the principles of the Constitution of the United States, and well-disposed to the good order and happiness of the U.S. during all relevant periods under the law.

Naturalization is typically achieved through two common pathways: sponsorship by a close relative or sponsorship by an employer. To qualify, both options necessitate a qualified sponsor.

In addition to the general categories, there are also specific circumstances that can lead to permanent resident status. These include being a victim of violent crime or human trafficking, as well as facing deportation that would result in exceptional and incredibly uncommon hardship for qualifying relatives. Our team at PVB Law LLC can assist you in determining whether you qualify under these circumstances.

We know these requirements go into great detail, but don't worry. We're here to help you understand and simplify your path to U.S. citizenship. With our personalized approach, bilingual capabilities, and a strong belief in keeping families together, we're ready to help you and your family through the process.

The Naturalization and Citizenship Process

The naturalization process involves multiple steps and can take several years to complete.

Once you've confirmed your eligibility, the process proceeds as follows:

  1. The process of becoming a naturalized citizen typically starts with filing a Form N-400, an application for naturalization with the U.S. Citizenship and Immigration Services (USCIS). After that, you will be scheduled for a biometrics appointment where your fingerprints and photographs will be taken. USCIS may ask you to attend an appointment to provide fingerprints for criminal background checks if you haven't already done so.

  1. Next, you will need to complete an interview with a USCIS officer. During this interview, you will be asked questions in English to test your language proficiency and also questions about U.S. history and government to test your knowledge of civics. Passing both the English and civics tests is necessary to proceed with the naturalization process and become a U.S. citizen.

After the interview, USCIS can grant or deny your application. However, they may not have a final decision right away because questions about your eligibility remain outstanding. They may request more documents if they need more information. Regardless of the outcome of your interview, the officer will provide you with a Notice of Examination Results (Form N-652).

Once the naturalization process is complete—and your application is approved—you will take the Oath of Allegiance and become a U.S. citizen. It's a momentous occasion, and we'll be there every step of the way, providing guidance and support to help ensure a successful outcome.
